Litigation Friend

A Litigation Friend is there to help people who don’t have the mental capacity to manage legal issues. This can include tasks such as working with a solicitor on their behalf.

In some cases, advocates may act as Litigation Friends because they know the person well and understand their needs. However, anyone—such as a family member or close friend—can serve as a Litigation Friend, provided they are fair and competent in fulfilling the role.

The Litigation Friend helps ensure the person’s views and wishes are represented during court proceedings through their solicitor.

Who might need this?

People who don’t have the capacity to instruct a solicitor for legal proceedings.

How can a Litigation Friend help?

Our advocates can act as Litigation Friends across a range of health and social care decisions to be made in court, ensuring the person’s rights and wishes are considered. This includes cases such as:

  • Complex community Deprivation of Liberty applications which may require an oral hearing
  • Where an application is made around health or welfare decisions to the Court of Protection
  • Where proceedings start to remove someone’s Nearest Relative under the Mental Health Act

Referrals for Litigation Friend usually come from:

  • The local authority
  • The NHS
